Terms of Use

Welcome to Daak 2. By accessing or using the Daak 2 mobile application (the "App"), you agree to comply with and be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, do not use the App.

1. License to Use

Lovely Duck, LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial purposes, subject to these Terms. This license does not transfer ownership. You may not:

1. Modify, copy, distribute, sell, lease, or sublicense the App or its materials;
2. Use the App or its materials for unauthorized commercial or public display;
3. Reverse engineer, decompile, or attempt to extract source code except where law permits;
4. Remove copyright, trademark, or other proprietary notices;
5. Use the App in a way that violates law, infringes rights, or disrupts its services.

This license terminates automatically if you violate these restrictions and may be revoked where permitted by law.

2. Your Data and Use of the App

You are responsible for the accuracy of information you enter, maintaining the security of your device and Apple account, and keeping appropriate backups. You must have the necessary rights to any content you add or share through the App. Features involving iCloud or sharing depend on Apple's services and availability.

3. Purchases

Purchases and entitlements offered through the App are processed by Apple and are also subject to the App Store's applicable terms. Pricing, payment, refunds, and purchase management are handled through your Apple account, except where applicable law requires otherwise.

4. Financial and Market Information

Daak 2 is a personal record-keeping tool. It does not provide financial, investment, tax, accounting, or legal advice. Market prices, exchange rates, calculations, charts, and other information may be delayed, incomplete, or inaccurate and should not be the sole basis for financial decisions. You remain responsible for verifying information and making your own decisions.

5. Disclaimer of Warranties

To the maximum extent permitted by law, the App and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or reliability.

6. Limitations of Liability

To the maximum extent permitted by law, Lovely Duck, LLC and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profits, or business interruption, arising from your use of or inability to use the App. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply.

7. Accuracy and Availability

The App may contain technical, typographical, calculation, or other errors. Features may change, be interrupted, or be discontinued. We may modify the App and its content at any time, but we do not undertake an obligation to update all information on a particular schedule.

8. Changes to These Terms

We may revise these Terms from time to time. The effective date at the top of this page identifies the latest version. By continuing to use the App after revised Terms take effect, you agree to the updated Terms.

9. Governing Law and Dispute Resolution

Except where prohibited by applicable law, these Terms and disputes arising from them are governed by the laws of the People's Republic of China. Disputes arising from or relating to the App shall be resolved by arbitration administered by the China International Economic and Trade Arbitration Commission (CIETAC) in Beijing under its rules then in effect. The decision will be final and binding.
